Etymology. The lock carries the surname of the Brazilian brothers it is named for. “Foot break” rather than “foot lock” is a deliberate choice in this phrasing — it records that the realistic outcome of a closed clasp is a fracture, not a submission by pain.
Mechanics. The midfoot has almost no range in the directions the clasp loads, so very little travel produces a break and the warning is absent rather than merely short. That is the mechanical reason the waiver exists: not that late escapes are low-percentage, but that no interval exists in which to attempt one.
